Introduction - submitting claims online
ClaimsAgent.nl is the new name for the trusted Crediteurenlijst.nl. Bankruptcies increasingly have international aspects. The new name fits better and is understandable for Dutch and foreign creditors.
ClaimsAgent.nl guides you in filing money claims with the trustee of a bankrupt company. The system works quickly and efficiently and reduces errors. Filing claims is free. As part of the service, you can subscribe to the reports with which the bankruptcy trustee reports on the settlement of the bankruptcy. That is also for free.
Instead of sending a letter to the trustee, you answer a number of questions on ClaimsAgent.nl. You will always find a brief explanation of these questions. This guidance ensures that you give the trustee all the information he or she needs about your claim. You can upload the evidence of your claim as an electronic file or photograph it with your smartphone. The data traffic between your computer and the ClaimsAgent.nl server is encrypted.
Your claim will automatically enter the administration of the trustee. And you will immediately receive a confirmation from the system by e-mail. That saves you and the trustee hassle and therefore time. And the less precious time the trustee needs to settle the bankruptcy, the more money remains to pay out to the creditors. And that's what bankruptcy settlement is all about.
When submitting your claim, you create an account, with which you can also manage your data later. This means: your own data, for example when you move house. Or the details of your monetary claim if it changes over time, for example because you have received the VAT back from the tax authorities.
Conditions for use of ClaimsAgent.nl
Use of the online system is subject to certain conditions, such as the obvious prohibition of making false claims and misuse of the system for improper purposes. But the conditions also determine how your data will be used and which conditions that use is bound to. You must accept the terms and conditions to use the system to make your claim.
Are you a bailiff or employee of a debt collection (law) office?
If you are not the creditor yourself, but submit a claim on behalf of a creditor, then simply enter the details of your client, even if it concerns the contact details. Please note: account registration will be confirmed to the email address entered as 'personal email address'. There you have to enter your own data for the time being. To ensure that both your client and yourself receive an acknowledgment of receipt of the submitted claim, enter the email address of the contact person at your client for the requested 'general email address'. If further communication only needs to take place afterwards with the client, your client can replace your e-mail address with his or her own e-mail address or another address and, if desired, change the password with the login codes (which you then share with your client).
You can alter your claim details. Log on and at the top of the screen click [view / alter submitted claim(s)].
Click the Insolvency name on the line of the claim. All claim details are shown. You can alter or add information.
Always enter a reason for the change made and save.
After submitting your claim(s), you can upload files (e.g. invoices, General Terms & Conditions). Log on and click [View submitted claims] at the top of your screen.
Click on the relevant insolvency name in the list that appears. All details of your claim will be shown.
You can select and add the files you wish to upload with the buttons in the section 'Evidence'.
You can also send a message to the trustee or amend your claim details in the calima detail screen.
You want to know what the status of your claim is: has the trustee acknowledged your claim, will there be a distribution in the bankruptcy or does the trustee need more documents?
Settling a bankruptcy takes time; it usually takes a year or more. Some trustees only recognise or contest claims when it is certain that a distribution can be made to the creditors.
Ask your question by clicking on [View / alter submitted claims] and selecting the claim about which you have a question. You can use the [Chat] button to ask the trustee in bankruptcy. It may sometimes take a while before you receive an answer.
N.B.: ClaimsAgent.nl only provides the software service for the filing of claims, but is not itself familiar with the substantive settlement thereof; you should therefore put questions about your claim to the trustee.
Sometimes it is not possible to upload attachments (such as invoices, general terms and conditions) directly when submitting the claim. This may have to do with the size of those documents (many MB's). It may also have another, technical cause. What goes wrong in that case we do not know.
However, you can still add attachments after submitting your claim. Log in and at the top of the screen, click [View / alter submitted claims].
Click on the name of the bankruptcy - in the claim line. All the details of the claim will be displayed.
Under [Evidence] you can then add attachments via 'Select a file' and then 'Add file(s)'.
If you Sign out and click [Login] again, click on the link 'Forgot password'. You will enter your email address and receive an email through which you can create and save a new password.
If you wish to access your claim details at a later moment to view or adjust your claim, you need to logon to your account. If you cannot find your claim under the button [view submitted claims], this can have two possible causes.
First, you may have registered multiple accounts with the same user name (e-mail address) in the past... this can be years apart.
You can check this by inserting your username to obtain a new password on the homepage.You will then receive an e-mail showing all accounts registered under the same username. Ask for a new password for those accounts and check in which account you find your claim.
Another possibility is that the trustee (or you yourself) has removed the claim. In that case it means: gone = gone. Sorry.
The personal e-mail address that has been provided when an account is registered, is your username to log on. If you wish to alter your e-mail address, you logon with your old e-mail address. Then you click on [Edit my account settings] and there you change your personal e-mail address into the new e-mail address. When you click [Edit] your new e-mail address is your new username.
NOTICE: your old password remains the same in the new situation.
